Article 1 – Definitions
In these terms and conditions, the following terms are defined as:
Cooling-off period: the period during which the consumer may exercise their right of withdrawal;
Consumer: a natural person who does not act in the course of business or profession and enters into a distance contract with the entrepreneur;
Day: calendar day;
Continuous transaction: a distance contract related to a series of products and/or services where the delivery and/or performance obligations are spread over time;
Durable data carrier: any medium that allows the consumer or entrepreneur to store information that is personally addressed to them, in a way that allows future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;
Distance contract: a contract concluded as part of a distance sales system, organized by the entrepreneur, where up to and including the conclusion of the contract, only remote communication techniques are used;
Remote communication technique: a means that can be used to conclude a contract without the consumer and entrepreneur being physically present at the same location.
General Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 3 – Applicability
These general terms and conditions apply to all offers from the entrepreneur and all distance agreements and orders between the entrepreneur and the consumer. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract that the general terms and conditions are available for review with the entrepreneur and will be sent to the consumer free of charge upon request. If the distance contract is concluded electronically, the text of these general terms and conditions can be provided electronically, so that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, it will be indicated before the conclusion of the contract where the general terms and conditions can be accessed electronically and that they will be sent to the consumer free of charge upon request. In case specific product or service terms also apply in addition to these general terms, the second and third paragraphs apply accordingly, and in case of conflicting terms, the consumer may rely on the provision most favorable to them. If one or more provisions in these general terms and conditions are at any time fully or partially invalid or annulled, the remainder of the agreement and these terms will remain in effect, and the invalid provision will be promptly replaced by a provision that closely approximates the original intent. Situations not addressed in these terms should be evaluated ‘in the spirit’ of these terms. Any uncertainties regarding the interpretation or content of one or more provisions should be explained ‘in the spirit’ of these terms.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be clearly stated in the offer. The offer is non-binding. The entrepreneur is entitled to modify and adjust the offer. The offer contains a complete and accurate description of the offered products and/or services. The description is detailed enough to allow the consumer to make a proper assessment of the offer. If the entrepreneur uses images, these are a truthful representation of the offered products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur. All images, specifications, and data in the offer are indicative and cannot give rise to compensation or cancellation of the agreement. Images of products are a truthful representation of the offered products. However, the entrepreneur cannot guarantee that the displayed colors exactly match the actual colors of the products. Each offer contains sufficient information to ensure the consumer understands their rights and obligations arising from accepting the offer, particularly: the price excluding taxes; any shipping costs; the method by which the contract is concluded and the actions required; whether the right of withdrawal applies; the method of payment, delivery, and execution; the acceptance period of the offer, or the period during which the entrepreneur guarantees the price; the rate of communication via distance techniques if the costs for using communication techniques are calculated based on something other than the regular base rate; whether the contract will be archived and how the consumer can consult it; how the consumer can verify and correct the data provided before concluding the contract; any other languages in which the contract can be concluded; the codes of conduct the entrepreneur is adhering to, and how the consumer can consult these codes; and the minimum duration of the distance contract for continuous transactions.
Article 5 – The Agreement
The agreement is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and meets the conditions set forth. If the consumer accepts the offer electronically, the entrepreneur will immediately confirm the receipt of the acceptance by electronic means. Until the receipt of this acceptance is confirmed, the consumer may cancel the agreement. If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the consumer can make payments electronically, the entrepreneur will take appropriate security measures. The entrepreneur may, within legal frameworks, assess whether the consumer can meet their payment obligations, as well as facts and factors that are important for the proper performance of the distance agreement. If the entrepreneur has legitimate grounds to refuse the agreement, they may refuse an order or impose special conditions for execution. The entrepreneur will provide the following information to the consumer in writing or in such a way that the consumer can easily store it on a durable data carrier:
a. the visit address where complaints can be addressed;
b. the terms and conditions of the right of withdrawal or a clear statement about the exclusion of the right of withdrawal;
c. information about warranties and after-purchase services;
d. the details listed in Article 4(3), unless the entrepreneur has already provided this information prior to the agreement’s execution;
e. the termination requirements if the agreement lasts more than one year or is indefinite. In case of continuous transactions, this provision only applies to the first delivery.
Article 6 – Right of Withdrawal
When purchasing products, the consumer has the right to cancel the agreement within 14 days without stating a reason. The cooling-off period begins the day after the consumer or a third party, designated by the consumer, receives the product. During the cooling-off period, the consumer must handle the product and its packaging with care. They will only unpack or use the product to the extent necessary to assess whether they want to keep the product. If the consumer exercises their right of withdrawal, they must return the product with all supplied accessories and, if reasonably possible, in the original condition and packaging as per the reasonable and clear instructions given by the entrepreneur. The consumer must inform the entrepreneur of their decision to withdraw within 14 days of receiving the product. The notification must be made via a written message/email. After notifying the entrepreneur of the withdrawal, the consumer must return the product within 14 days. The consumer must prove that the products were returned on time, e.g., by providing proof of return. If the consumer does not notify the entrepreneur of their withdrawal or return the product within the specified period, the sale is final.
Article 7 – Costs in the Event of Withdrawal
If the consumer exercises their right of withdrawal, the return shipping costs are borne by the consumer. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, and no later than 14 days after withdrawal, provided that the product has been returned or proof of return can be provided.
Article 8 – Exclusion of Right of Withdrawal
The entrepreneur may exclude the consumer’s right of withdrawal for products as described in paragraphs 2 and 3. The exclusion of the right of withdrawal applies only if the entrepreneur clearly indicates this in the offer or at least before concluding the agreement.
Article 9 – The Price
During the validity period specified in the offer, the prices of the offered products and/or services will not increase, except for price changes due to VAT rate changes. However, products or services subject to fluctuations in the financial market that the entrepreneur cannot influence may be offered with variable prices. The offer will indicate that these prices are subject to such fluctuations. Price increases within 3 months after the agreement is concluded are only allowed if they result from legal regulations. Price increases after 3 months are only allowed if the entrepreneur has agreed upon it and:
a. they result from legal regulations;
b. the consumer has the right to cancel the agreement when the price increase takes effect.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications mentioned in the offer, and the reasonable requirements for quality and usability. If agreed, the entrepreneur also guarantees that the product is suitable for other than normal use. A warranty provided by the entrepreneur, manufacturer, or importer does not affect the legal rights the consumer can exercise under the agreement. Any defects or wrongfully delivered products must be reported to the entrepreneur within 14 days after delivery. Products must be returned in their original packaging and in new condition. The warranty period provided by the entrepreneur corresponds to the manufacturer's warranty period. However, the entrepreneur is not responsible for the suitability of the products for any individual application by the consumer, nor for any advice regarding the use or application of the products.
Article 11 – Delivery and Execution
The entrepreneur will exercise the utmost care when accepting and executing orders for products. The place of delivery is the country where the transport begins. In this case, the delivery will take place outside the EU, so the shipping or courier company will charge the customer import VAT and/or clearance fees. Therefore, the entrepreneur will not charge VAT. The entrepreneur will execute accepted orders without undue delay, but no later than 30 days, unless the consumer agrees to a longer delivery period. If there are delays in delivery, or if an order cannot be fully or partially executed, the consumer will be informed no later than 30 days after placing the order. The consumer has the right to cancel the agreement without any cost and is entitled to compensation.
